In my last post, I wrote about the Mortgage Forgiveness Act, and how it might impact your investing, and more specifically, your short sale business.
In today’s New York Times, there was a very thought provoking op-ed piece about what really does affect housing prices, and how the Act plays (or doesn’t play) a role in housing prices.
Prior to this act, banks and lenders, if negotiating a short sale, were allowed to tax homeowners on the amount of debt negotiated and send them a form 1099. Ultimately, what this meant to the homeowner is that the forgiven debt was treated as income. Here’s an example:
Fred and Mary Smith had a home with a loan balance of $300,000. Harry Investor purchased it, after negotiating a successful short sale, for for $225,000. The lender, in the past, could have sent a form 1099 to the Smiths, and the $75,000 of debt that “magically” disappeared would have been treated as taxable income.
With this new law in effect, that $75,000 will no longer be treated as income. At least until the end of 2009.
So what does this mean for you, as the investor?
Well first things first, I would absolutely print out a copy of this new Mortgage Forgiveness Act and take it on any appointment with me where I was meeting with a homeowner who was entertaining the possibility of a short sale.
Next, I would focus on finding as many short sale deals as possible.

Well, I’m off to the airport in a few hours to fly to LAX to spend Christmas with my Mum in Redondo Beach. Should be a nice relaxing week.
As for real estate, there’s a name out there that you might have heard. This guy has an ebook out there that the big time “GURUS” are freaking out about, because he’s giving away so much information for just $50!
I tracked him down in Naples, Florida, earlier this year, and got him to agree to interview. To my knowledge, it’s the first time he’s ever agreed to appear on camera.

It’s Christmas time, so I wanted to be able to give all of our readers and subscribers a gift. Something that is of value, that hopefully you can use, and that is, well, a gift!

I know that Cris Chico’s name has been getting out there a LOT, lately. And with good reason. Cris is doing some unbelievable things with Virtual Investing. I personally met Cris for the first time at the Virtual Investing Seminar in New Orleans. He will totally change the way you think about investing.
